Article 1. Peamble
THE PRESENT CONDITIONS OF SALE ARE CONCLUDED ON THE ONE HAND BY THE COMPANY ONVIEW WHOSE HEAD OFFICE IS LOCATED AT “AVENUE EDMOND CANDRIES 39”, REGISTERED AT “LA BANQUE CARREFOUR DES ENTREPRISES” UNDER THE NUMBER BE0744.884.576. HEREINAFTER REFERRED TO AS ONVIEW AND MANAGING THE WEBSITE HTTP://ONVIEW-SHOP.COM, ON THE OTHER HAND, BY ANY PERSON OR ENTITY WISHING TO MAKE A PURCHASE ON THE WEBSITE, HEREINAFTER REFERRED TO AS “THE BUYER”.
Article 2. Purpose
The present condition of sale defines the contractual relations between the seller and the buyer as well as the conditions applicable to any purchase made through the seller’s site. The acquisition of a good through this site implies an unreserved acceptance by the buyer of these conditions of sale.
These conditions of sale prevail over any other general or special conditions not expressly approved by the seller.
The seller reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer.
Article 3. The product
The products for sale are those listed on the seller’s website. Each product is accompanied by a description established by the supplier and/or the seller.
The photos in the catalog are as faithful as possible but cannot ensure a perfect similarity with the product, particularly in terms of colors.
The products are sold within the limit of available stocks. If, despite its effort, all or part of the items are unavailable, the seller informs the buyer by email as soon as possible and offers him the possibility to choose between waiting or cancelling the order of the unavailable items at no charge.
Article 4. Prices
The prices of the products displayed on the site are indicated in euros, all taxes included (VAT and other applicable taxes). The seller reserves the right to modify its prices at any time. Nevertheless, the prices applicable to the order are those in force at the time of confirmation of the order.
The prices indicated do not include delivery costs which will be specified to the buyer upon confirmation of the order according to the delivery method chosen.
Article 5. Delivery
Our Products are delivered to the buyer at the seller’s head office or place of business. Consequently, the buyer bears the transport and the risks relating to the products as soon as he takes possession of them and, failing that, as soon as they are made available to him. In the case that the buyer chose another place of delivery, removal and, if necessary, the storage of the products will be carried out at the purchaser’s risk and expense. Delivery times are given as an indication. No delay in delivery can give rise to the cancellation by the buyer of the contract of sale or to the cancellation by the seller. This clause does not apply to buyer acting for non-professional purposes. In addition, the seller has the right to refuse to sell its products based on the availability and sufficiency of its stocks, or for any other legitimate reason, an retains the right to make partial deliveries.
Article 6. Orders
The order is executed online only and exclusively on the website. The customer commits to the accuracy of his personal data and the information provided during the order. The click to validate the order constitutes an irrevocable commitment on his part.
Article 7. Methods of payment
The buyer will have the possibility to make the payment according to the payment method of his choice: Maestro, Credit Card or Paypal. The items ordered remain the exclusive property of the seller until full payment of the order by the buyer and no delivery will be made before receipt of payment of the full amount of the order by the seller.
Article 8. Right of withdrawal
In accordance with the law of 6 April 2010 on market practices and consumer protection, the customer is entitled to notify that he renounces the purchase, without penalties and without giving any reason, within 14 working days from the day after the day of delivery of the product.
The right of withdrawal does not apply if the products are used or damaged.
The customer shall return the order, in its original packaging, at his own expense. He has a maximum period of 14 working days from de day after the day of delivery of his order to do so. Following his renunciation, the customer will be reimbursed within 30 days, of the of his initial order. These conditions are valid only for purchase.
Article 9. Warranties
The goods are subject to the legal warranty provided by the law of 1 September 2004 on the protection of consumers in the case of the sale of consumer goods. The seller shall be liable to the consumer for any lack of conformity which exists at the time of delivery of the goods which appears within two years of delivery.
The buyer who notes the non-conformity must notify the seller within 2 months of the report, by registered letter.
Article 10. Responsibility
the seller, in the online sales process, is only bound by an obligation of means. Its liability cannot be engaged for any damage resulting from the use of the internet network and online payment such as loss of data, intrusion, viruses, …
Article 11. Intellectual property
All elements of the seller’s site are the exclusive intellectual property of the seller. No one is authorised to reproduce, exploit, redistribute or use for any purpose whatsoever, even partially, elements of the site, be they software visual or audio.
Any simple link or hypertext link is strictly forbidden without the prior written agreement of the seller.
Article 12. Personal data
All the personal data required for process an order is stored by the seller or his employees and may be passed on to compagnies with which the seller collaborates, where such communication is necessary to process the order.
The buyer also authorises the seller to use this data to draw up statistics in order to improve its site and the goods it offers for sale.
This information may also be used for marketing purposes in order to enable the seller to make its commercial activities known to its customers.
Article 13. Settlement of disputes
These terms and conditions of sale are subject to Belgian law.
In the event of a dispute, the courts of the seller’s registered office shall have exclusive jurisdiction, unless otherwise provided by mandatory public policy.
